[摘  要]信息自由的思想由来已久，经过300余年的演变和发展，已在各国信息立法理论和实践中得到验证，经过大量的前期调研发现，政府信息公开无非就是法规调整下的人的具体行为，主要包含法律法规和行政行为两个层面。以EBSCOhost和Elsevier为数据来源，以其收录的20年来国外政府信息公开文献为研究对象，从影响因素、政策执行、用户需求和社会参与四个方面评述国外政府信息公开中的行政行为；从法律适用、法律比较和法律完善三个方面评述国外政府信息公开中的法律法规，为国内政府信息公开的改革提供借鉴。

经过公众，尤其是新闻界10多年的努力，1966年美国国会终于通过了一项具有划时代意义的旨在促进政府信息公开化的行政法规—《信息自由法》（“Freedom of Information Act”，FOIA），并于次年7月4日正式生效，1996年又制定并实施了《电子信息自由法》（“Electronic Freedom of Information Act”，EFOIA），形成了较为完备的信息公开法律体系，并对其他国家和地区的信息公开立法进程产生了深远的影响。政府信息公开的思想可以追溯至1766年瑞典颁布的《出版自由法》，经过300余年漫长而曲折的发展，至今至少已有80多个国家和地区相继制定和实施了类似的法律法规，进入21世纪以来，信息技术的迅猛发展和网络的快速普及，使得政府信息公开所面临的社会环境发生了质的变化，类如电子政府性质的开放式民主化行政观念已经深入人心，相关领域内的学者们也将研究的目光聚焦在了政府信息公开问题上，出现了一大批内容丰富，观点鲜明的理论成果，以及颇具成效的实践探索。

 

一、译法界定、数据来源与研究方法

 

（一）政府信息公开的译法界定

 

从国内的相关文献可知，“政府信息”通常译为“government information”，这一点没有争论，而“政府信息公开”则存在不同的英文译法，如“government information publicity”，“government information publication”，“open government information”，“disclosure of government information”或“government information disclosure”，以及“access to government information”等等，若去掉修饰语“政府”二字，“信息公开”也存在多样译法，如“freedom of information”，“information disclosure”，“information publicity”，因此在对外文数据库进行检索时，较为繁琐，需要兼顾各类英文译法，避免遗漏重要文献。

Overview of Researches on Foreign Government Information Publicity Based on Bibliometric (1993-2012)

[Abstract]The idea of freedom of information has a long history, after more than 300 years of evolution and development, it has been verified in the theory and practice of national information legislation, after lots of preliminary research, it can be found that government information publicity is human's specific behavior under the statute adjustment which consists of two levels. Based on the databases of EBSCOhost and Elsevier, takes the foreign government information publicity literature as study object, administrative acts are reviewed from influence factor, policy implementation, user needs, social participation; laws and regulations are reviewed from legal application, comparison of laws, legal perfection, provide a reference for the reform of government information publicity.
